BY AFFIRMING THAT YOU AGREE WITH THESE TERMS, OR ACCESSING OR USING ANY PART OF THIS WEB SITE, YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THIS AGREEMENT FOR ALL PAST, PRESENT AND FUTURE USES BY YOU OF THE Originalpoetry.com WEBSITE. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THIS WEB SITE. Originalpoetry.com RESERVES THE RIGHT TO MAKE CHANGES TO THIS AGREEMENT AT ANY TIME. CONTINUED USE OF ANY PART OF THIS WEB SITE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. ACCORDINGLY, YOU SHOULD REVIEW THIS AGREEMENT FROM TIME TO TIME TO BECOME FAMILIAR WITH SUCH CHANGES.

ANY MEMBER OR NON-MEMBER WHO DOES NOT AGREE WITH THESE TERMS AND CONDITIONS CAN REFUSE TO REGISTER OR TERMINATE THEIR MEMBERSHIP.

USE OF OUR WEBSITE OR SERVICES OR THE PURCHASE OF PRODUCTS AFTER POSTED CHANGES MEANS THAT YOU CONSENT TO THE PRIVACY POLICIES AS CHANGED.

General Rules

  1. You will comply with all of the terms and conditions of this Agreement and all applicable laws, regulations and rules when you use Originalpoetry.com.
  2. Originalpoetry.com may modify the Originalpoetry.com terms of use at any time with or without notice to you.
  3. If Originalpoetry.com determines, in its sole and absolute discretion, that you will breach a term or condition of this Agreement by uploading pornographic images or plagiarizing or otherwise does not meet the standards of Originalpoetry.com, Originalpoetry.com may terminate or disable a membership.
  4. To become a Member, you must register with Originalpoetry.com through its online registration process. Only Members have the right to view premium content and rate poems.
  5. You must provide Originalpoetry.com with accurate and complete contact information if you become a Originalpoetry.com member. If you dp not submit a valid email address, Originalpoetry.com is not responsible if you do not receive site updates or receive support for any site problems (i.e. resovling abuse reports, profile glitches, etc.)
  6. You will need to select a password if you become a member. You will be responsible for all use of your password, including, without limitation, any use by any unauthorized third party. You must notify Originalpoetry.com immediately if you believe your password has been or may be obtained or used by any unauthorized person or entity.
  7. Generally, you must use Originalpoetry.com in a manner that demonstrates original work. Biting or plagiarism is prohibited. If a member is caught with plagiarized work, their membership will be terminated. If a non-member is caught with plagiarized work, they will no longer be able to post a poem under their nickname. We understand that different nicknames can be used to conceal one's identity. Originalpoetry.com has no control over that. Originalpoetry.com will block the IP address of the user or member who submitted the plagiarized work and Originalpoetry.com will simply not accept any with plagiarized work. Please publish your own writings.
  8. No one may post any copyrighted material unless the copyright is owned by you or you have consent from the owner of the copyrighted material. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also inappropriate for Originalpoetry.com.
  9. No member or user is allowed to use another member's account to post messages, rate poems or browse this community.
  10. You understand that all information, data, text, software, music, sound, photographs, graphics, artwork, video, messages or other materials ("content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not Originalpoetry.com, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the site. Originalpoetry.com does not control the Content posted via the site and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the site, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Originalpoetry.com be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the site.
  11. If you submit content to Originalpoetry.com (on a message board, in connection with your participation in a Originalpoetry.com contest, or otherwise) you hereby grant Originalpoetry.com an unrestricted and unlimited license to use such content (or any portion thereof) on the Originalpoetry.com Web site, in email "newsletters" or other promotional materials (collectively referred to as "Promotions") to promote or advertise any of your sites or Originalpoetry.com, or to allow external entities to republish the material in conjunction with promoting and/or advertising the Originalpoetry.com website, or to republish such content on the Originalpoetry.com site or affiliates' sites, as the company sees fit, with or without identifying the content as yours on the Promotions, provided that your content is identified as yours on the Originalpoetry.com website within a reasonable period of time subsequent to submission to Originalpoetry.com.
  12. Originalpoetry.com will not use any content submitted or uploaded for monetary gain without the permission of the submitter.
  13. Sexually explicit photos/graphics will not be allowed on Originalpoetry.com. If you choose to post sexually explicit photos, YOUR PROFILE WILL BE TERMINATED. If you currently have pictures that are sexually explicit, YOUR PROFILE WILL BE TERMINATED.
  14. To maintain the integrity of the site, members can report abuse by other members to Originalpoetry administrators. Members can report abuse against other members for the following: harassment, excessive and persistent use of profanity, stalking, or any member conducting themselves in a manner that is detrimental are harmful to community. Prolonged misbehavior and complaints made by members will result in the accusing member's profile to be disabled or terminated.
  15. NOTE: UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS FEES INCURRED BY Originalpoetry.com, OR BY ANY COPYRIGHT OWNER'S LICENSEE THAT IS INJURED AS A RESULT OR A MISREPRESENTATION. IN ADDITION, YOU MAY ALSO BE SUBJECT TO CRIMINAL CHARGES FOR PERJURY, IN ACCORDANCE WITH APPLICABLE LAW. Originalpoetry.com PROSECUTES TO THE FULL EXTENT ALLOWABLE BY LAW.
  16. Sexually explicit photos/graphics will not be allowed on Originalpoetry.com. If you choose to post sexually explicit photos, YOUR PROFILE WILL BE TERMINATED. If you currently have pictures that are sexually explicit, YOUR PROFILE WILL BE TERMINATED.
  17. The use of gratuitous profanity, violence, or gratuitous sexual representations will not be allowed on OriginalPoetry.com. If you feel that your poetry requires the use of these devices, then your poetry is not for OriginalPoetry.com. If you choose to post poems of this nature YOUR PROFILE WILL BE TERMINATED. If you currently have poems up of this nature, YOUR PROFILE WILL BE TERMINATED.
  18. Your email address will be used by us to contact you when we have site bulletins, update information, account specific information, special offers, third party offers to other sites and or services, promotional offers and or commercial messages, or other information to provide you. Such information may include, without limitation, new services offered by us, information relating to your account and other information related to your subscription to the Site. We may send you emails prior to and after you have terminated your membership to our service until such time as you advise us, in accordance with the procedures explained below, that you no longer wish to receive email from us. If you no longer wish to receive emails from us please unsubscribe from by sending us an email with "unsubscribe" in the subject line to support@originalpoetry.com, or by using the unsubscribe feature contained within all of our emails. We and our advertising partners fully comply with the federal CAN-SPAM Act and as such all emails from us and our advertising partners will always, among other required disclosures, have a place for you to opt out of receipt of further email correspondence. Please note we will never send you an email directly or through our marketing partners without your consent. Please immediately report any emails you may receive, without your prior authorization, which purport to promote the Site.
